Terms of Service for St. Lawrence College of Applied Arts and Technology Electronic and Digital Services

1. Introduction
These terms and conditions, together with any documents and/or additional terms are expressly incorporated by reference (collectively, the "Terms of Service"), constitute a legal agreement and are entered into by and between St. Lawrence College of Applied Arts & Technology ("St. Lawrence College," "we," "us," "our") and you as a user (“User”, “you”, “your”).
These Terms of Service govern all electronic and digital services offered by St. Lawrence College, including but not limited to all content and functionality offered on or through https://www.stlawrencecollege.ca/, SLC.me and all electronic platforms offered thereunder (collectively the “Services”).
By accessing, purchasing, or using the Services, you signify that you have read, understood, and agree to be bound and comply with these Terms of Service and, you acknowledge and agree to our “Privacy Notice “which is also made available to you and incorporated herein by reference. If you do not agree to these Terms of Service, you must not purchase, download, install, register with, access, or use the Services.
2. Use of the Services
By using the Services, you agree to:
- Use the Services solely for educational, administrative, or other purposes approved by St. Lawrence College; and
- Comply with all applicable laws, regulations, and St. Lawrence College policies, including Ontario’s Freedom of Information and Protection of Privacy Act (FIPPA), and any applicable Canadian federal laws.
3. Prohibited Activities:
As a condition of your access and use of the Services, you agree that you shall not engage in any of the following activities (collectively “Prohibited Activities”) in connection with the use of any Services:
- In any manner violate any applicable federal, provincial, local, or international law or regulation or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Terms of Service and/or our Privacy Notice;
- Engage in any behavior, or transmit any data that contains any material that is harassing, defamatory, violent, abusive, hateful, sexually explicit, discriminatory, or otherwise objectionable, such determination to be made our sole and absolute discretion;
- Distribute harmful software, such as viruses or malware;
- Use or permit any unauthorized use of St. Lawrence College’s intellectual property;
- Impersonate or attempt to impersonate, St. Lawrence College, an employee or agent of St. Lawrence College, another user, or any other person or entity;
- Transmit or procure the sending of, any advertisements or promotions, including without limitation, any “spam” or unsolicited communications;
- Disseminate false or misleading information that could harm St. Lawrence College or its community members;
- Take any steps to access or permit unauthorized access to accounts or attempt to breach St. Lawrence College’s IT systems; and/or
- Engage in any activities that disrupt, damage, or impair the Services.
4. Registration
As part of using the Services, you may be required from time to time to register user accounts. Any password, or any other piece of information chosen by you, or provided to you as part of our security procedures, must be treated as confidential, and you must not disclose it to any other person or entity. You are responsible for any password misuse or any unauthorized access.
We reserve the right at any time and from time to time, to disable or terminate your account(s), any username, password, or other identifier, whether chosen by you or provided by us, in our sole discretion for any or no reason, including any violation of any provision of these Terms of Service.
5. Privacy and Data Protection & CASL
St. Lawrence College is committed to protecting your privacy in accordance with Canadian privacy law standards. By submitting your personal information to us for the use of our Services, you consent to the collection, use, reproduction, hosting, transmission, and disclosure of any such content submissions as we deem necessary or useful for the provision of the Services, in each case accordance with our Privacy Notice.
All Services offered by St. Lawrence College comply with Canada’s Anti-Spam Legislation (CASL). You may opt out of receiving non-essential communications at any time by following the unsubscribe instructions provided in the communication or contacting St. Lawrence College directly. Please review our Privacy Notice for more details.
6. Third Party Services
For your convenience, our Services may provide links, pointers or access points to third-party sites, services and platforms (collectively “Third Party Services”). We make no representations or warranties about any Third Party Services. If you choose to access any such Third Party Services, you do so at your own risk and any information (including personal information) you provide to such Third Party Services is outside of our control. We have no control over the contents of any such Third Party Services and accept no responsibility for such sites, services, or platforms or for any loss or damage that may arise from your use of them. You acknowledge that you may be subject to specific terms, conditions, privacy policies and licensing of such Third Party Services. All statements and/or opinions expressed in any such Third Party Services are solely the opinions and the responsibility of such third-party authors. Content made available through Third Party Services do not necessarily reflect the opinion of St. Lawerence College, even if accessed by you through or in connection with our Services. You acknowledge and agree that St. Lawrence College hereby disclaims all liability for any issues arising from your use of Third Party Services.
7. User Content and Media Interaction
When you submit any content (such as messages, media, or posts) through our Services (each a “User Submission”), you:
- Grant St. Lawrence College a worldwide, non-exclusive, perpetual, royalty-free, irrevocable license to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material. You further waive any moral rights or other rights of authorship as a condition of submitting any User Submission;
- Declare and warrant that you own or have the necessary legal right to submit the User Submission, share the content, and to grant the license described above;
- Represent and warrant that all User Submissions comply with applicable laws and regulations and the provisions set out in these Terms of Service;
- Understand and agree that you, not St. Lawrence College, are fully responsible for any User Submissions you submit or contribute, and you are fully responsible and legally liable, including to any third party, for such content and its accuracy; and
- Acknowledge that St. Lawrence College reserves the right to remove or restrict content that violates these Terms of Service or applicable laws, including Ontario’s Human Rights Code.
8. Multi-Channel Communication with Students
St. Lawrence College may communicate with students via multiple channels, including WhatsApp, email, SMS, and social media. By opting into any of these channels, you agree to:
- Receive official St. Lawrence College communications, such as academic updates, alerts, and information relevant to your studies;
- Maintain up-to-date contact information and ensure that you can receive these communications; and
- Understand that communications made through any Third Party Services are subject to their respective terms of service and that opting out may limit your ability to receive important updates.
9. Disclaimer of Warranties Regarding Services
You understand and agree that your use of the Services is at your own risk. St. Lawrence College provides its Services on an 'as is' and 'as available' basis without any representations, warranties, or conditions of any kind, either express or implied. Without limiting the generality of the foregoing, St. Lawrence College does not guarantee uninterrupted, error-free or secure access its Services, or that defects will be corrected, or that the Services are free of viruses or other harmful components. Neither St. Lawrence College nor its directors, officers, employees, agents, nor their respective successors make any warranty, representation or endorsement with respect to the completeness, security, reliability, suitability, accuracy, currency or availability of the Services or its content thereon. You are solely and entirely responsible for your use of the Services and your computer, internet, and data security. To the fullest extent provided by law, we will not be liable for any loss or damage caused by denial-of-service attack, distributed denial-of service attack, overloading, flooding, mailbombing, or crashing, viruses, trojan horses, worms, logic bombs, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Services or any services or items found or attained through the Services or to your downloading of any material posted on it.
10. General Limitation of Liability
To the fullest extent permitted by law, St. Lawrence College, and its directors, officers, employees, agents and their respective successors shall not be held liable for any for any losses or damages of any kind in respect of the Services or any Third Party Services, including but not limited to any damages or losses arising from:
- Loss of data or communication;
- Unauthorized access or alteration of your communications;
- Breach of security or privacy related to third-party services; and/or
- Loss of revenue, loss of profits, loss of business or anticipated savings,
whether caused by tort, breach of contract, or otherwise.
11. Enforcement and Consequences of Violations
St. Lawrence College reserves the right, without provision of notice, to investigate and take appropriate legal action for any actual or alleged violation of these Terms of Service, including but not limited to:
- Suspending or terminate access to any or all of the Services;
- Removing or refusing to post any User Submissions for any or no reason in our sole discretion;
- Reporting illegal activities to the appropriate authorities and notify the harmed party of any illegal or unauthorized use of the Services; and/or
- Pursuing appropriate civil or criminal action where applicable.
We have no obligation, nor any responsibility to any party to monitor the Services or their use, and do not and cannot undertake to review User Submissions. We cannot ensure prompt removal of objectionable material after it has been posted and we have no liability for any action or inaction regarding transmissions, communications, or content provided by any user or third party, subject to applicable laws.
12. Data Retention and Deletion
St. Lawrence College retains user data for as long as necessary to fulfill the purposes for which it was collected or to comply with legal obligations. You have the right to request deletion of your data in accordance with applicable laws by contacting the Privacy Office at privacyoffice@sl.on.ca. 13. Force Majeure
St. Lawrence College shall not be liable for any delay or failure in performance resulting from events beyond its reasonable control, including but not limited to acts of God, natural disasters, government actions, labor strikes, or technical failures.
14. Dispute Resolution
All disputes arising in connection with these Terms of Service and/or the use of the Services shall be dealt with in accordance with this paragraph. Any such dispute set out in writing, containing particulars of the dispute. Within 60 days after receipt of such written dispute notice we will meet and/or correspond with you in good faith with a view to resolution of the dispute (the “Resolution Period”). In the event the dispute is not resolved prior to the expiry of the Resolution Period, St. Lawerence College or User may require that the dispute be settled by a sole arbitrator under the Arbitration Act, 1991 (Ontario), which arbitrator shall be mutually agreed upon (or failing which appointed by the Courts of Ontario), by arbitration in Kingston, Ontario, conducted in the manner determined by the arbitrator. Information provided as part of such arbitration shall be held in confidence and there shall be no disclosure to any person except as necessary for resolution of the dispute. The arbitrator shall determine all matters of law and jurisdiction and shall have the right to grant legal and equitable relief including injunctive relief, and final and interim damages awards. Costs shall be determined at the discretion of the arbitrator. Any decision or award of the arbitrator may be enforced in a court of competent jurisdiction in Ontario and shall be final and binding. Notwithstanding the forgoing, this provision does not prohibit St. Lawerence College from seeking equitable relief to protect its confidential information or intellectual property rights in the Courts of Ontario.
15. Governing Law and Jurisdiction
These Terms of Service are governed by the laws of the Province of Ontario and the applicable federal laws of Canada. St. Lawerence College is based in Ontario, Canada. The Services are not intended for use in any jurisdiction where they are not permitted. If you access the Services from outside of Canada, you do so at your own risk and you are responsible for compliance with local laws of your jurisdiction.
16. Accessibility
St. Lawrence College is committed to providing accessible communications in accordance with the Accessibility for Ontarians with Disabilities Act (AODA). If you require materials in an alternate format, please contact marketing@sl.on.ca for assistance.
17. Intellectual Property
You acknowledge and agree that the Services, features, functionality, and any content displayed or made available in connection with the Services including but not limited to text, graphics, logos, software, code, displays, graphics, photographs, images, video, audio, design, presentation selection and arrangement, are owned by St. Lawrence College, or its licensors, or other providers of such material and are protected in all forms by intellectual property laws, including without limitation, copyright, trademark, patent, trade secret and any other proprietary rights. Use of any such property, except as expressly authorized, shall constitute a violation of the rights of the property owner and may be a violation of federal or other laws and could subject the violator to legal action.
The “St. Lawrence College” name and all related logos and emblems and slogans are trademarks of St. Lawrence College. You must not use such marks without the prior written permission of the St. Lawrence College.
You may only use the Services for your personal and non-commercial use. Users are prohibited from republishing or creating derivative works of any content without our explicit permission.
18. Modifications to the Terms of Service and Content
St. Lawrence College reserves the right, in our sole discretion, to change, modify, add, update or delete portions of these Terms of Service at any time and from time to time. Any and all such modifications are effective immediately upon posting and apply to all access to and continued use of the Services. Your continued use of the Services after any changes are posted constitutes your acceptance of the updated Terms of Service. It is your responsibility, and you agree to regularly review the Terms of Service found on this page in order to stay informed of any changes.
Further, the information and material provided through the Services may be changed, withdrawn, or terminated at any time in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the Services are restricted to users or unavailable at any time or for any period.
19. Conflict in Terms
If St. Lawerence College makes available specific terms and conditions to you in respect of any Services that are mutually agreed upon (collectively “Specific Terms”), any conflict or inconsistency between the Specific Terms and these Terms of Service shall be resolved in favour of the Specific Terms.
20. General
No waiver under these Terms of Service is effective unless it is in writing and signed by an authorized representative of the party waiving its right. No failure to exercise, or delay in exercising, any right, remedy, power or privilege arising from these Terms of Service operates, or may be construed, as a waiver thereof. No single or partial exercise of any right, remedy, power or privilege hereunder precludes any other or further exercise thereof or the exercise of any other right, remedy, power or privilege. If any term or provision (or part thereof) of these Terms of Service is invalid, illegal or unenforceable in any jurisdiction, such invalidity, illegality or unenforceability shall not affect any other term or provision of these Terms of Service or invalidate or render unenforceable such term or provision in any other jurisdiction.
